Efficient College Applications, LLC (d/b/a CollegeZapps™) ("CollegeZapps," "we" or "us") has developed this privacy policy (the "Privacy Policy") for the benefit of the users ("Users" or "you") of its Web site located at index.asp (the "Site") to demonstrate our serious commitment to protecting privacy on this Site. The following information summarizes CollegeZapps' personal data gathering and distribution practices for the Site. CollegeZapps reserves the right to change this Privacy Policy, or any other policy or practice, at any time. Your use of this Site will be conclusively deemed acceptance of this Privacy Policy, and your continued use of this Site following any change(s) or modification(s) to this Privacy Policy will be conclusively deemed acceptance of this Privacy Policy as modified. Why does CollegeZapps need your personal information? CollegeZapps collects certain personal information in order for CollegeZapps to provide you with this service, for CollegeZapps to enhance and improve this service and, where you have affirmatively "opted-in," for specified advertisers to present more relevant products and/or services. What personal information does CollegeZapps collect from you? CollegeZapps collects information from your online application(s), IP addresses, cookies, Web site tracking software, and certain other ways. Online Application(s). As you complete the CollegeZapps application, CollegeZapps collects certain personal information from you (such as your name, e-mail address, and parent's name, if applicable). CollegeZapps also requires you to enter your credit card information in order to pay any applicable CollegeZapps fees. During the CollegeZapps registration process, CollegeZapps will give you a username (the "User ID") and ask you to create a password. With your User ID and password, you may access CollegeZapps' online services and select the universities, colleges or other schools (each a "School") to which you want to apply. The CollegeZapps service will generate an interview for you that, after you have finished, will generate a completed application form for each School you selected. You may then print hard copies of the applications and submit the applications directly to the relevant School(s) together with payment to each School of any applicable School application fees. IP Addresses. Whenever you visit the Site, the Web server may automatically collect the IP address of the computer you are using. We will also likely save the phone numbers, e-mail addresses, Web browsers and operating systems of those Users that send us "Technical Support" requests. Cookies. "Cookies" are small pieces of information that are stored by your Web browser software on your computer's hard drive or temporarily in your computer's memory. The use of cookies is now an industry standard, and Users will find them on most Web sites. CollegeZapps may place and store cookies on your hard drive to enable CollegeZapps to recognize your access privileges to this Site. Software and Traffic Measurement. CollegeZapps may allow third party network advertisers to serve advertisements on the Site and may use a traffic measurement service to analyze traffic on the Site. Network advertisers are third parties that display advertisements based on your visits to the Site and other Web sites you have visited. Third-party ad serving enables us to target advertisements to you for products and services in which you might be interested. Although most Web browsers are initially set up to accept cookies. Users should understand that certain areas within this Site may not function properly if the Web browser will not accept cookies. No personal information from children. This Site is not primarily intended for individuals under the age of sixteen (16) ("children"). Accordingly, CollegeZapps will not knowingly collect any information from children without parental or guardian consent. Moreover, CollegeZapps will not knowingly collect or use any personal data collected from children for any purpose whatsoever, including disclosure to any third party. How does CollegeZapps use your personal information? As previously noted, CollegeZapps will collect your name and e-mail address, along with certain credit card information (by which you pay for our service). In addition, you may choose to "opt-in" to receive relevant advertisements and coupons from third party advertisers. By voluntarily "opting-in," you are giving us your express consent to share your personal information with such third party advertisers (subject to this Privacy Policy) so that you can receive certain supplemental services available on this Site. If you do not "opt-in", then CollegeZapps will not share your personal information with anyone other than (i) our Web service providers, (ii) credit card processors and (iii) a potential acquirer (if any) that proposes to acquire CollegeZapps (regardless of whether through merger with or into, or purchase of all or substantially all of the assets of, CollegeZapps). CollegeZapps also reserves the right to disclose personal information when we reasonably think that disclosing this information is necessary in connection with a legal action we might bring against someone who might be violating any provision of our User Agreement or any of our policies, or who may be interfering (either intentionally or unintentionally) with CollegeZapps, other CollegeZapps Users or any other party. Furthermore, CollegeZapps may disclose personal information when we think in good faith that the law requires it. Finally, CollegeZapps may, and does, disclose personal information in aggregate form (i.e., not in an individually identifiable manner) to third parties or advertisers. How may you access, update or correct your personal information? You may access your registration information by using your User ID and password. If you request that CollegeZapps revise your registration information, then CollegeZapps will make reasonable efforts to see that your requested revisions are made. If you provide incorrect information that CollegeZapps submits to a credit card processor, then you must contact the credit card processor directly to alert them to the incorrect information. What CollegeZapps does to keep this Site secure. CollegeZapps uses certain security features designed to prevent the unauthorized release of, or access to, personal information. First, CollegeZapps grants access to personal information only to authorized personnel. Second, provides a secure server, which encrypts all information a User inputs before it is sent, that Users use when registering online or accessing account information through this Site. Please be advised, however, that although CollegeZapps has endeavored to create a secure and reliable Site for its Users, the confidentiality of any communication or material transmitted to/from CollegeZapps via this Site or e-mail cannot be guaranteed. When disclosing any personal information, you should remain mindful of the fact that it is potentially accessible to the public and, consequently, can be collected and used by others without User consent. Accordingly, you should consider carefully if you want to submit sensitive information that you would not want disclosed to the public and you should recognize that your use of the Internet and this Site is solely at your own risk. Users, alone, are ultimately responsible for maintaining the secrecy of their personal information. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us online. Once we receive your transmission, we use reasonable efforts to ensure its security on our systems; however, we cannot accept liability for disclosure of any personal information due to errors in transmission or unauthorized acts of third parties. We also recommend that you do not divulge your User password to anyone. Also, especially where you share your computer or are using a computer in a public place like a library or Internet "cafe," please remember to sign out of your CollegeZapps registration account and close your browser window when you have finished your work to prevent others from accessing your personal information and correspondence. What about external Web sites? To the extent hyperlinks on this Site are utilized to access third party sites, Users should be aware that these third party Web sites are not controlled by CollegeZapps and, therefore, are not subject to this Privacy Policy. Users should check the privacy policies of these individual sites to see how their personal information will be utilized by the proprietors of those third party Web sites. How long will CollegeZapps retain your information? CollegeZapps retains your personal information on its primary server for the entire application admissions cycle (which ends on or about June 1 of each calendar year). Once the academic year ends in June, we move your personal information and "archive" it for a certain amount of time on a remote server. Please note that, even after we have archived your personal information, we reserve the right to access your personal information for various reasons, including without limitation to compile statistical and/or historical information about the previous year's applications, and to assist a current applicant who had created or submitted an application the previous year. Certain privacy rights if you are a California resident. If you are a resident of California, then under California Civil Code §1798.83, you may request information about the third parties with whom CollegeZapps shared your personal information in the immediately preceding calendar year if those third parties used your personal information for direct marketing purposes. As a California resident, you may submit one request per calendar year for a report that details: (a) what type of information CollegeZapps shared, (b) with whom CollegeZapps shared such information and (c) the nature of the third party business.
